Effective Date: January 1, 2025 | Last Updated: July 2026

These Storage Host Terms ("Storage Host Terms") govern your use of SwiftSpot's platform for listing storage spaces. These terms supplement our general Host Terms of Service and apply specifically to storage space listings.

  • Reserve the right to inspect for prohibited items
  • Report suspected illegal items to appropriate authorities
  • Not knowingly allow storage of prohibited items

4.2 Your Rights

You have the right to:

  • Refuse any items not permitted in your listing
  • Terminate rentals if prohibited items are discovered
  • Enter the space to remove hazardous or illegal items
  • Cooperate with law enforcement without liability

4.3 Local Compliance

As a Storage Host, you are responsible for ensuring your listing and permitted uses comply with all applicable bylaws, zoning, land-use rules, HOA or lease restrictions, and insurance requirements. SwiftSpot does not determine local legality of a use; you must document permitted scope accurately in your listing and ensure renters use the space only as described.

5. Liability and Insurance

5.1 Your Liability

As a Storage Host, you may be liable for damage to stored items only in cases of:

  • Gross negligence: Reckless disregard for the safety of stored items
  • Willful misconduct: Intentional acts causing damage
  • Misrepresentation: Material false statements about storage conditions

You are NOT liable for:

  • Theft or burglary (unless caused by your negligence)
  • Natural disasters or force majeure events
  • Damage from environmental conditions disclosed in your listing
  • Damage caused by the renter's own items or negligence
  • Pest damage (unless you knew of and concealed an infestation)

5.2 Insurance Recommendations

Important Insurance Notice

SwiftSpot does NOT provide insurance coverage for Storage Hosts. We strongly recommend:

  • Reviewing your homeowner's or commercial property insurance
  • Obtaining additional liability coverage for rental activities
  • Consulting with an insurance professional about storage rental coverage

6. Access and Inspections

6.1 Renter Access

You must provide renters with access as described in your listing. When access changes, update your listing and notify booked guests through booking messages if the change affects an upcoming stay.

6.2 Your Right to Enter

You may enter the rented storage space:

  • In emergencies (fire, flood, security breach)
  • For inspection with 24-hour notice (except emergencies)
  • To make necessary repairs
  • When required by law enforcement with proper documentation
  • After termination of the rental agreement
  • When payment is more than 14 days overdue

7. Abandoned Property Procedures

7.1 When Property is Abandoned

A renter's property may be considered abandoned when:

  • The rental period has ended AND items remain for 30+ days
  • Rent is unpaid for 30+ consecutive days after notice
  • The renter provides written notice of abandonment
  • The renter cannot be contacted for 60 days despite reasonable efforts

7.2 Notice Requirements

Before disposing of abandoned property, you must:

  • Send written notice to the renter's email and phone on file
  • Wait the required period under applicable provincial/state law
  • Document all attempts to contact the renter
  • Follow SwiftSpot's abandonment notification process

7.3 Disposal Process

After proper notice and waiting periods:

  • Items may be sold at public or private sale
  • Proceeds apply first to amounts owed to you
  • Any surplus must be held for the renter or remitted according to law
  • Items with no resale value may be donated or disposed of
  • Document the entire process for your records

8. Lien Rights

Depending on your jurisdiction, you may have a lien on stored property for:

  • Unpaid rent and fees
  • Damages to your property caused by stored items
  • Costs of enforcing the rental agreement

Lien rights vary by province/state. Consult with a legal professional to understand your rights and obligations.

9. Cancellation Policies

9.1 Renter Cancellation Rights

Important: Host-selected advance cancellation

Storage bookings are prepaid for a fixed duration. You choose Standard (30+ days before start) or Flexible (14+ days before start) on the listing. Bookings keep the policy in effect when booked. This protects you as a host by giving you time to find replacement renters.

Renter cancellation refund eligibility:

  • Within 5 minutes of booking: Full refund (grace period for booking errors)
  • Before the listing’s free-cancel cutoff: Full refund (Standard: 30+ days; Flexible: 14+ days)
  • Within the free-cancel window of start: No refund (you keep the payment, too close to relist)
  • Active rentals (already started): No refund (renter already paid for the period)

This policy protects your rental income and aligns with standard commercial storage industry practices. You receive the full prepaid amount for any cancellation within the free-cancel window of the start date or after the rental has started.

9.2 Host Cancellation Restrictions

Once a storage booking is confirmed and paid, you cannot cancel or modify it yourself. This protects renters who have planned their storage needs around your availability. The same host booking rules as our Host Terms apply:

  • Starts more than 2 weeks away: Submit a change request in the host portal for SwiftSpot review
  • Starts within 2 weeks: Contact SwiftSpot support (self-serve change requests are not available)
  • Pending (unconfirmed) requests: You may reject the request

9.3 Exceptions and Escalation

SwiftSpot may approve a host-requested cancellation or schedule change when warranted, including when:

  • You have a documented emergency
  • The renter has violated terms (for example: prohibited items or permitted-use / compliance issues reported through the booking issue report flow)
  • Safety concerns require immediate termination

For active rentals, submit an issue report on the booking first (category: permitted use / compliance or other, as appropriate). SwiftSpot reviews reports and decides whether to terminate the rental, require cure, or take other action. You cannot unilaterally void a prepaid storage rental.

Repeated cancellations may result in account penalties or suspension.

10. Privacy and Surveillance

10.1 Surveillance Disclosure

If you have surveillance cameras or monitoring:

  • You MUST disclose this in your listing
  • Cameras must NOT be inside the storage space itself
  • Common areas and entry points may be monitored if disclosed
  • You must comply with all privacy laws regarding surveillance

10.2 Renter Privacy

You must respect renter privacy:

  • Do not share renter information with third parties
  • Do not photograph or inventory renter's belongings
  • Provide access only to authorized persons

11. Tax Responsibilities

As a Storage Host, you are responsible for:

  • Reporting all rental income to tax authorities
  • Collecting and remitting applicable sales taxes (if required)
  • Maintaining records for tax purposes
  • Understanding your local tax obligations for rental income

SwiftSpot may provide annual earnings statements but does not provide tax advice.
